{"id":28,"date":"2018-12-20T16:08:53","date_gmt":"2018-12-20T16:08:53","guid":{"rendered":"https:\/\/optimusnet.us\/?page_id=28"},"modified":"2026-06-25T17:26:31","modified_gmt":"2026-06-25T17:26:31","slug":"terms-of-services","status":"publish","type":"page","link":"https:\/\/optimusnet.us\/?page_id=28","title":{"rendered":"Terms of Services"},"content":{"rendered":"<p><\/p>\n<h1 class=\"wp-block-heading\">OPTIMUS COMMUNICATIONS, LLC<\/h1>\n<p><\/p>\n<p><\/p>\n<h2 class=\"wp-block-heading\">SERVICE AGREEMENT &amp; TERMS OF SERVICE<\/h2>\n<p><\/p>\n<p><\/p>\n<p class=\"wp-block-paragraph\">This Service Agreement (&#8220;Agreement&#8221;) is entered into between <strong>Optimus Communications, LLC<\/strong> (&#8220;Optimus,&#8221; &#8220;we,&#8221; &#8220;our,&#8221; or &#8220;us&#8221;) and the undersigned customer (&#8220;Customer,&#8221; &#8220;you,&#8221; or &#8220;your&#8221;).<\/p>\n<p><\/p>\n<p><\/p>\n<p class=\"wp-block-paragraph\">By signing this Agreement or using Optimus Communications services or equipment, you acknowledge that you have read, understood, and agree to be bound by these Terms and Conditions.<\/p>\n<p><\/p>\n<p><\/p>\n<hr class=\"wp-block-separator has-alpha-channel-opacity\"\/>\n<\/p>\n<p><\/p>\n<h1 class=\"wp-block-heading\">1. BROADBAND INTERNET SERVICE<\/h1>\n<p><\/p>\n<p><\/p>\n<p class=\"wp-block-paragraph\">Optimus Communications, LLC provides broadband Internet services (&#8220;Broadband,&#8221; &#8220;Fiber,&#8221; &#8220;Wireless,&#8221; &#8220;High-Speed Internet,&#8221; &#8220;IPTV,&#8221; &#8220;VoIP,&#8221; or &#8220;Service&#8221;) in accordance with the terms of this Agreement.<\/p>\n<p><\/p>\n<p><\/p>\n<h2 class=\"wp-block-heading\">Service Plans<\/h2>\n<p><\/p>\n<p><\/p>\n<figure class=\"wp-block-table\">\n<table class=\"has-fixed-layout\">\n<tbody>\n<tr>\n<th>Plan<\/th>\n<th>Download \/ Upload Speeds<\/th>\n<th>Monthly Rate<\/th>\n<\/tr>\n<tr>\n<td>Surfer<\/td>\n<td>25 Mbps \/ 3 Mbps<\/td>\n<td>$60.00<\/td>\n<\/tr>\n<tr>\n<td>Protector<\/td>\n<td>50 Mbps \/ 5 Mbps<\/td>\n<td>$80.00<\/td>\n<\/tr>\n<tr>\n<td>Guardian<\/td>\n<td>100 Mbps \/ 20 Mbps<\/td>\n<td>$110.00<\/td>\n<\/tr>\n<tr>\n<td>Family Freedom<\/td>\n<td>300 Mbps \/ 100 Mbps<\/td>\n<td>$130.00<\/td>\n<\/tr>\n<\/tbody>\n<\/table>\n<\/figure>\n<p><\/p>\n<p><\/p>\n<p class=\"wp-block-paragraph\">Optimus Communications reserves the right to modify service plans, pricing, and available features with prior notice.<\/p>\n<p><\/p>\n<p><\/p>\n<h2 class=\"wp-block-heading\">Service Charges<\/h2>\n<p><\/p>\n<p><\/p>\n<p class=\"wp-block-paragraph\">Service charges are established at the time of order. Unless otherwise specified in a written contract, Optimus Communications reserves the right to change rates upon notice delivered via email, postal mail, website posting, or billing statement. Continued use of the Service after notice constitutes acceptance of any modifications.<\/p>\n<p><\/p>\n<p><\/p>\n<p class=\"wp-block-paragraph\">Additional charges may include:<\/p>\n<p><\/p>\n<p><\/p>\n<ul class=\"wp-block-list\"><\/p>\n<li>Reconnection Fee (after suspension for non-payment): <strong>$40.00<\/strong><\/li>\n<p><\/p>\n<p><\/p>\n<li>On-Site Service Calls Beyond the Demarcation Point: <strong>$80.00 per hour<\/strong><\/li>\n<p><\/ul>\n<p><\/p>\n<p><\/p>\n<hr class=\"wp-block-separator has-alpha-channel-opacity\"\/>\n<\/p>\n<p><\/p>\n<h1 class=\"wp-block-heading\">2. PAYMENTS<\/h1>\n<p><\/p>\n<p><\/p>\n<p class=\"wp-block-paragraph\">Customers agree to the following payment terms:<\/p>\n<p><\/p>\n<p><\/p>\n<ul class=\"wp-block-list\"><\/p>\n<li>Bills are issued monthly or annually in advance.<\/li>\n<p><\/p>\n<p><\/p>\n<li>Payment is due on the due date indicated on the invoice or on the first day of the billing cycle.<\/li>\n<p><\/p>\n<p><\/p>\n<li>Late payments are subject to:\n<ul class=\"wp-block-list\"><\/p>\n<li>Interest of <strong>1.5% per month<\/strong> on unpaid balances.<\/li>\n<p><\/p>\n<p><\/p>\n<li>A <strong>$30.00 returned payment fee<\/strong> for returned checks or failed electronic payments.<\/li>\n<p><\/ul>\n<p><\/li>\n<p><\/p>\n<p><\/p>\n<li>Accounts more than thirty (30) days past due may be suspended, disconnected, or referred to collections.<\/li>\n<p><\/p>\n<p><\/p>\n<li>Customers are responsible for all applicable taxes, governmental fees, and surcharges.<\/li>\n<p><\/p>\n<p><\/p>\n<li>Optimus Communications reserves the right to recover unpaid balances, including reasonable attorney&#8217;s fees, court costs, and collection expenses.<\/li>\n<p><\/ul>\n<p><\/p>\n<p><\/p>\n<h3 class=\"wp-block-heading\">Billing Disputes<\/h3>\n<p><\/p>\n<p><\/p>\n<p class=\"wp-block-paragraph\">Any billing dispute must be submitted in writing within sixty (60) days of the invoice date.<\/p>\n<p><\/p>\n<p><\/p>\n<hr class=\"wp-block-separator has-alpha-channel-opacity\"\/>\n<\/p>\n<p><\/p>\n<h1 class=\"wp-block-heading\">3. EQUIPMENT AND SECURITY<\/h1>\n<p><\/p>\n<p><\/p>\n<p class=\"wp-block-paragraph\">All leased, rented, or provided equipment remains the property of Optimus Communications, LLC unless otherwise specified in writing.<\/p>\n<p><\/p>\n<p><\/p>\n<p class=\"wp-block-paragraph\">Upon termination of Service:<\/p>\n<p><\/p>\n<p><\/p>\n<ul class=\"wp-block-list\"><\/p>\n<li>Equipment must be returned within thirty (30) days.<\/li>\n<p><\/p>\n<p><\/p>\n<li>Equipment must be returned in good working condition, normal wear and tear excepted.<\/li>\n<p><\/p>\n<p><\/p>\n<li>Customers will be charged current replacement costs for equipment that is not returned, is damaged, or is otherwise rendered unusable.<\/li>\n<p><\/ul>\n<p><\/p>\n<p><\/p>\n<p class=\"wp-block-paragraph\">Customers are solely responsible for:<\/p>\n<p><\/p>\n<p><\/p>\n<ul class=\"wp-block-list\"><\/p>\n<li>Computer hardware and networking equipment.<\/li>\n<p><\/p>\n<p><\/p>\n<li>Device maintenance and software updates.<\/li>\n<p><\/p>\n<p><\/p>\n<li>Data security and backup.<\/li>\n<p><\/p>\n<p><\/p>\n<li>Virus and malware protection.<\/li>\n<p><\/ul>\n<p><\/p>\n<p><\/p>\n<p class=\"wp-block-paragraph\">Optimus Communications is not responsible for data loss, equipment damage, cybersecurity incidents, or virus-related issues.<\/p>\n<p><\/p>\n<p><\/p>\n<hr class=\"wp-block-separator has-alpha-channel-opacity\"\/>\n<\/p>\n<p><\/p>\n<h1 class=\"wp-block-heading\">4. INTERFERENCE AND CONNECTIVITY<\/h1>\n<p><\/p>\n<p><\/p>\n<p class=\"wp-block-paragraph\">Wireless Internet performance may be affected by factors outside the control of Optimus Communications, including but not limited to:<\/p>\n<p><\/p>\n<p><\/p>\n<ul class=\"wp-block-list\"><\/p>\n<li>Distance from transmission facilities.<\/li>\n<p><\/p>\n<p><\/p>\n<li>Terrain, foliage, or physical obstructions.<\/li>\n<p><\/p>\n<p><\/p>\n<li>Weather conditions.<\/li>\n<p><\/p>\n<p><\/p>\n<li>Interference from wireless devices such as routers, cordless phones, microwaves, and similar equipment.<\/li>\n<p><\/ul>\n<p><\/p>\n<p><\/p>\n<p class=\"wp-block-paragraph\">Optimus Communications will provide troubleshooting and support up to the customer&#8217;s designated demarcation point. Customers are responsible for issues caused by customer-owned equipment or internal network configurations.<\/p>\n<p><\/p>\n<p><\/p>\n<hr class=\"wp-block-separator has-alpha-channel-opacity\"\/>\n<\/p>\n<p><\/p>\n<h1 class=\"wp-block-heading\">5. NON-REFUNDABILITY<\/h1>\n<p><\/p>\n<p><\/p>\n<p class=\"wp-block-paragraph\">All installation fees, setup fees, activation fees, and other one-time charges are non-refundable.<\/p>\n<p><\/p>\n<p><\/p>\n<p class=\"wp-block-paragraph\">Equipment purchased from Optimus Communications includes a thirty (30) day warranty beginning on the installation date unless otherwise stated in writing.<\/p>\n<p><\/p>\n<p><\/p>\n<p class=\"wp-block-paragraph\">After the applicable warranty period expires, all sales are final.<\/p>\n<p><\/p>\n<p><\/p>\n<hr class=\"wp-block-separator has-alpha-channel-opacity\"\/>\n<\/p>\n<p><\/p>\n<h1 class=\"wp-block-heading\">6. LIMITATION OF LIABILITY<\/h1>\n<p><\/p>\n<p><\/p>\n<p class=\"wp-block-paragraph\">Optimus Communications shall not be liable for interruptions, delays, or failures in Service resulting from causes beyond its reasonable control, including but not limited to:<\/p>\n<p><\/p>\n<p><\/p>\n<ul class=\"wp-block-list\"><\/p>\n<li>Equipment failures<\/li>\n<p><\/p>\n<p><\/p>\n<li>Power outages<\/li>\n<p><\/p>\n<p><\/p>\n<li>Natural disasters<\/li>\n<p><\/p>\n<p><\/p>\n<li>Acts of God<\/li>\n<p><\/p>\n<p><\/p>\n<li>War<\/li>\n<p><\/p>\n<p><\/p>\n<li>Labor shortages<\/li>\n<p><\/p>\n<p><\/p>\n<li>Government actions<\/li>\n<p><\/p>\n<p><\/p>\n<li>Network congestion or third-party service failures<\/li>\n<p><\/ul>\n<p><\/p>\n<p><\/p>\n<p class=\"wp-block-paragraph\">In the event of a service interruption attributable to Optimus Communications, the Customer&#8217;s sole remedy shall be a prorated credit for the affected period.<\/p>\n<p><\/p>\n<p><\/p>\n<p class=\"wp-block-paragraph\">UNDER NO CIRCUMSTANCES SHALL OPTIMUS COMMUNICATIONS BE LIABLE FOR INDIRECT, INCIDENTAL, SPECIAL, EXEMPLARY, OR CONSEQUENTIAL DAMAGES.<\/p>\n<p><\/p>\n<p><\/p>\n<hr class=\"wp-block-separator has-alpha-channel-opacity\"\/>\n<\/p>\n<p><\/p>\n<h1 class=\"wp-block-heading\">7. INDEMNIFICATION<\/h1>\n<p><\/p>\n<p><\/p>\n<p class=\"wp-block-paragraph\">Customer agrees to indemnify, defend, and hold harmless Optimus Communications, LLC and its officers, employees, agents, and affiliates from any claims, liabilities, damages, losses, costs, or expenses, including reasonable attorney&#8217;s fees, arising from:<\/p>\n<p><\/p>\n<p><\/p>\n<ul class=\"wp-block-list\"><\/p>\n<li>Customer&#8217;s use of the Service.<\/li>\n<p><\/p>\n<p><\/p>\n<li>Violation of this Agreement.<\/li>\n<p><\/p>\n<p><\/p>\n<li>Misuse of the Service.<\/li>\n<p><\/p>\n<p><\/p>\n<li>Violation of applicable laws or regulations.<\/li>\n<p><\/ul>\n<p><\/p>\n<p><\/p>\n<hr class=\"wp-block-separator has-alpha-channel-opacity\"\/>\n<\/p>\n<p><\/p>\n<h1 class=\"wp-block-heading\">8. TERMINATION<\/h1>\n<p><\/p>\n<p><\/p>\n<p class=\"wp-block-paragraph\">Optimus Communications may suspend or terminate Service immediately if:<\/p>\n<p><\/p>\n<p><\/p>\n<ul class=\"wp-block-list\"><\/p>\n<li>Payment obligations are not met.<\/li>\n<p><\/p>\n<p><\/p>\n<li>The Service is used in violation of this Agreement.<\/li>\n<p><\/p>\n<p><\/p>\n<li>Customer activity disrupts service to other customers.<\/li>\n<p><\/p>\n<p><\/p>\n<li>Fraudulent, unlawful, or unauthorized activity occurs.<\/li>\n<p><\/p>\n<p><\/p>\n<li>Regulatory or legal requirements prevent continued service.<\/li>\n<p><\/ul>\n<p><\/p>\n<p><\/p>\n<h2 class=\"wp-block-heading\">Customer-Initiated Cancellation<\/h2>\n<p><\/p>\n<p><\/p>\n<p class=\"wp-block-paragraph\">Customers must provide at least fifteen (15) days written notice before their next billing date to avoid charges for the upcoming billing cycle.<\/p>\n<p><\/p>\n<p><\/p>\n<h2 class=\"wp-block-heading\">Early Termination<\/h2>\n<p><\/p>\n<p><\/p>\n<p class=\"wp-block-paragraph\">Customers subject to a term commitment or promotional agreement may be charged:<\/p>\n<p><\/p>\n<p><\/p>\n<ul class=\"wp-block-list\"><\/p>\n<li>A <strong>$200.00 Early Termination Fee<\/strong>, and<\/li>\n<p><\/p>\n<p><\/p>\n<li>Repayment of any promotional discounts or incentives received.<\/li>\n<p><\/ul>\n<p><\/p>\n<p><\/p>\n<hr class=\"wp-block-separator has-alpha-channel-opacity\"\/>\n<\/p>\n<p><\/p>\n<h1 class=\"wp-block-heading\">9. ACCEPTABLE USE POLICY<\/h1>\n<p><\/p>\n<p><\/p>\n<p class=\"wp-block-paragraph\">Customers agree not to use the Service for unlawful, abusive, or prohibited purposes, including but not limited to:<\/p>\n<p><\/p>\n<p><\/p>\n<ul class=\"wp-block-list\"><\/p>\n<li>Harassment or intimidation.<\/li>\n<p><\/p>\n<p><\/p>\n<li>Fraudulent activities.<\/li>\n<p><\/p>\n<p><\/p>\n<li>Defamation.<\/li>\n<p><\/p>\n<p><\/p>\n<li>Distribution of obscene, illegal, or harmful content.<\/li>\n<p><\/p>\n<p><\/p>\n<li>Unauthorized resale or redistribution of Service.<\/li>\n<p><\/p>\n<p><\/p>\n<li>Activities that interfere with network operations or other customers.<\/li>\n<p><\/ul>\n<p><\/p>\n<p><\/p>\n<p class=\"wp-block-paragraph\">Violations may result in immediate suspension or termination of Service.<\/p>\n<p><\/p>\n<p><\/p>\n<hr class=\"wp-block-separator has-alpha-channel-opacity\"\/>\n<\/p>\n<p><\/p>\n<h1 class=\"wp-block-heading\">10. GENERAL PROVISIONS<\/h1>\n<p><\/p>\n<p><\/p>\n<h2 class=\"wp-block-heading\">No Waiver<\/h2>\n<p><\/p>\n<p><\/p>\n<p class=\"wp-block-paragraph\">Failure by Optimus Communications to enforce any provision of this Agreement shall not constitute a waiver of its right to enforce such provision in the future.<\/p>\n<p><\/p>\n<p><\/p>\n<h2 class=\"wp-block-heading\">Severability<\/h2>\n<p><\/p>\n<p><\/p>\n<p class=\"wp-block-paragraph\">If any provision of this Agreement is determined to be unenforceable or invalid, the remaining provisions shall remain in full force and effect.<\/p>\n<p><\/p>\n<p><\/p>\n<h2 class=\"wp-block-heading\">Governing Law<\/h2>\n<p><\/p>\n<p><\/p>\n<p class=\"wp-block-paragraph\">This Agreement shall be governed by and construed in accordance with the laws of the State of Colorado.<\/p>\n<p><\/p>\n<p><\/p>\n<h2 class=\"wp-block-heading\">Assignment<\/h2>\n<p><\/p>\n<p><\/p>\n<p class=\"wp-block-paragraph\">Optimus Communications may assign this Agreement without notice. Customers may not assign or transfer their rights or obligations under this Agreement without prior written consent.<\/p>\n<p><\/p>\n<p><\/p>\n<h2 class=\"wp-block-heading\">Amendments<\/h2>\n<p><\/p>\n<p><\/p>\n<p class=\"wp-block-paragraph\">Unless otherwise prohibited by law, Optimus Communications may modify these Terms and Conditions by providing at least thirty (30) days notice through billing statements, email, postal mail, or website posting.<\/p>\n<p><\/p>\n<p><\/p>\n<p class=\"wp-block-paragraph\">Continued use of the Service following notice constitutes acceptance of the revised terms.<\/p>\n<p><\/p>\n<p><\/p>\n<hr class=\"wp-block-separator has-alpha-channel-opacity\"\/>\n<\/p>\n<p><\/p>\n<h1 class=\"wp-block-heading\">11.
